Heartist Terms of Use

Last updated: 7 October 2026

1. Introduction

Please read these terms (the “Terms”) carefully. They govern how you use Heartist's websites and apps (together, the “Service”): the listener app where you discover and play music, buy releases and merchandise, and follow artists; and the workspace where artists and managers build their press kit (EPK), publish music, run a shop and manage industry contacts, follow-ups and bookings.

By creating an account, signing in with Google or Facebook, or simply browsing the Service, you agree to these Terms, to our Privacy Policy, Cookie Policy and User Guidelines, and to the Purchase terms when you buy something. If you do not agree, please do not use the Service.

Some parts of the Service may be browsed without an account. Playing, following, saving, buying and every creator feature need one.

2. The Heartist Service

Heartist offers different experiences depending on your role:

  • Listeners discover creators, play tracks and podcasts, keep playlists, follow artists, join fan clubs and buy music, merchandise and coins.
  • Artists publish a profile with posts, music, releases and a shop, and may build and publish a press kit (EPK) with Heartist Premium.
  • Managers run one or more artists: contacts, pipeline, planner, bookings and press kit.
  • Administrators operate the platform and curate its catalogue.

We may add, change or remove features, and we may limit access to part of the Service, for example to protect it or to meet legal obligations. Previews and music may be offered in limited form to people who are not signed in.

3. Your account

You must be at least 16 years old, or the age of digital consent in your country if higher, to create an account. If you are younger, a parent or guardian must agree to these Terms on your behalf.

You must give accurate information and keep it up to date. Signing in needs a confirmed email address. You can also sign in with a Google or Facebook account; we then receive the name and email address that provider shares with us.

You are responsible for everything that happens under your account. Keep your password secret, choose one you do not use elsewhere, and tell us immediately at support@heartist.app if you think someone else has access. Changing or resetting your password ends your other sessions.

One person, one account. Do not create accounts to evade a suspension or a limit, or sell and transfer accounts.

4. Using the Service

We give you a personal, non-exclusive, revocable licence to use the Service for your own non-commercial entertainment (listeners) or to promote and manage your own artistic activity or that of the artists you manage (creators), according to these Terms.

You agree not to:

  • copy, download, record or redistribute music or other content except where the Service explicitly allows it (for example, a purchase that includes a download);
  • bypass or interfere with security, previews, paywalls, rate limits or the player;
  • use bots, scrapers or automated means to collect data or to inflate plays, follows, likes or sales;
  • upload malware, or probe or test the vulnerability of the Service;
  • use the Service to harass others, to send spam, or for anything unlawful or against the User Guidelines;
  • pretend to be someone else, or to be connected to an artist, label or company you are not.

Do not use the contact tools of the workspace to send unsolicited bulk messages. The CRM is for keeping track of your own professional conversations, and you remain responsible for complying with the law that applies to them, including data protection and marketing rules.

5. Content and rights

Music, artwork, text, images, video, merchandise listings and other material on Heartist (“Content”) belong to the creators, labels and other rights holders who provide it, or to Heartist. Using the Service does not give you ownership of any Content.

When you upload or publish Content (tracks, posts, images, press-kit material, shop items, comments), you keep your rights in it. You grant Heartist a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical purposes (for example, resizing images or generating previews of tracks), display, stream and distribute it through the Service for as long as you keep it published, and as needed to operate and promote the Service.

You promise that you own or control all rights needed to publish what you upload, that it does not infringe anyone else's rights, and that it follows the User Guidelines. You are responsible for splits, royalties and any payment owed to collaborators, producers, publishers or collecting societies.

See our Intellectual property policy to report content you believe infringes your rights.

6. Purchases, coins and Premium

Some features are paid: coins, tracks, releases, merchandise, fan-club memberships and Heartist Premium. Prices, taxes, delivery and refund rules are set out in the Purchase terms, which form part of these Terms.

Coins are a prepaid balance to use inside Heartist. They have no cash value, are not a bank deposit and cannot be transferred or redeemed for money except where the law says otherwise.

7. Moderation, suspension and termination

We may remove Content, restrict features, suspend or close accounts, with or without notice, if we reasonably believe you have broken these Terms or the User Guidelines, to protect people or the Service, or to comply with the law. Where we can, we will tell you why and how to appeal at support@heartist.app.

You can stop using the Service and ask us to close your account at any time by writing to privacy@heartist.app. Terms that by their nature should survive (such as rights in content already shared, liability and disputes) continue after your account ends.

8. Third-party services and links

The Service may link to, or let you sign in with, services we do not control, such as Google, Facebook, streaming platforms, social networks, payment providers or an artist's own website. Their terms and privacy practices apply to your use of them, and we are not responsible for them.

9. Availability and liability

We work to keep Heartist available and accurate, but the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, or that any booking, sale or business result will follow from using it. Information in the CRM, planner and analytics is entered by users and only as reliable as that input.

To the extent the law allows, Heartist is not liable for indirect or consequential loss, loss of profit, opportunity or data, or for what other users or third parties do. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

10. Changes to these Terms

We may update these Terms, for example when we add features or when the law changes. We will post the new version here with its date and, for material changes, tell you in the Service or by email. If you keep using Heartist after a change takes effect, you accept it; if you do not, you can close your account.

11. Contact and disputes

Questions about these Terms: legal@heartist.app. Help with your account: support@heartist.app.

If we cannot solve a problem together, these Terms are governed by the law of the country in which Heartist is established, and its courts have jurisdiction, without taking away the protection that mandatory consumer law of your country of residence gives you.
